Terms and conditions
Business customers only. MuloCart equipment is sold and hired to businesses, sole traders and other organisations for use in their trade. We don't sell to consumers. By placing an order you confirm you're buying for business purposes.
1. About these terms
These terms apply to every sale, hire and demonstration of MuloCart powered stair climbers and accessories ("Goods") by MuloCart ("we", "us"). "You" means the business placing the order.
These terms override any terms you send us, unless we agree otherwise in writing. Anything in a written quote or order confirmation that differs from these terms takes priority over them.
2. Quotes, reservations and orders
- Prices on our website and in brochures are an invitation to order, not an offer. A written quote is valid for 30 days unless it says otherwise.
- You can reserve a unit without payment. A reservation holds stock for you, but it is not a contract and either of us may cancel it before dispatch.
- A contract is formed only when we send you a written order confirmation (by email is fine).
- We may decline an order, for example if stock is unavailable or we can't verify the buyer. If we've taken payment, we'll refund it in full.
3. Prices and payment
- Prices are in pounds sterling and exclude VAT, which is added at the current rate. Our standard 200 kg unit is £1,995 + VAT (£2,394 inc VAT at 20%), unless your quote says otherwise.
- Delivery, extra batteries, accessories and on-site training are charged as stated in your quote.
- Unless we've agreed credit terms in writing, you pay in full before we dispatch the Goods. There's no payment until we're ready to dispatch.
- If we agree credit terms and you pay late, we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998, and suspend further deliveries.
4. Delivery and collection
- We deliver to addresses in mainland Great Britain. Scottish Highlands, islands and Northern Ireland may cost more and take longer; we'll confirm this before you order.
- You can collect from our Derby location by appointment, and we'll show you how the unit works on the day.
- Delivery dates are estimates. We'll keep you updated, but we aren't liable for losses caused by a delay. If dispatch is more than 30 days late, you can cancel and get a full refund of anything you've paid.
- Someone must be available to receive the Goods at the delivery address.
5. Risk and ownership
Risk passes to you when the Goods are delivered or collected. Ownership passes to you when we've received full payment. Until then, you must keep the Goods insured, in good condition and identifiable as ours.
6. Checking your delivery
Please check the Goods on arrival. Tell us about any damage, shortage or wrong item within 5 working days of delivery, with photos if possible, and we'll repair, replace or credit it. Hidden defects are covered by the warranty below.
7. Warranty
- We warrant that the Goods will be free from defects in materials and workmanship for the warranty period stated in your quote or order confirmation. Batteries are covered for the same period against failure to hold a charge, other than normal ageing.
- If a defect appears, tell us promptly. We'll repair or replace the faulty part or unit, or refund the price, at our choice. We hold spares (batteries, wheels and drive belts) in the UK, and repairs are carried out in the UK.
- The warranty doesn't cover wear and tear (including tracks, castors and straps), damage from overloading beyond the rated load, misuse, use on unsuitable stairs, use without training, incorrect charging, unauthorised modification or repair, or accidental damage.
- This warranty replaces all other warranties, conditions and terms implied by law, including those under the Sale of Goods Act 1979, as far as the law allows between businesses.
8. Safe use
- MuloCart stair climbers are designed for moving goods only.
- Never exceed the rated load stated on the unit and in its manual. Always strap the load to the frame with the straps supplied.
- Use only on stairs within the stated limits (currently riser under 21 cm and tread over 25 cm, with enough landing space). They aren't suitable for spiral stairs.
- Only trained operators should use the Goods. You're responsible for your own risk assessments, including under the Manual Handling Operations Regulations 1992, and for following the user manual.
9. Hire and hire-to-buy
Hire is offered where available, from £45 per week + VAT. Each hire is covered by a separate written hire agreement, which sets out the hire period, deposit, your responsibility for loss and damage, and any amount of hire fees that will be credited if you buy the unit. If that agreement conflicts with these terms, the hire agreement wins.
10. Demonstrations
Free demonstrations at your premises are by appointment and depend on availability and location. During a demo, our staff operate the unit or supervise your staff. You must give us safe access to the stairs, tell us about any known hazards, and make sure the load and stairs are suitable.
11. Cancellation and returns
Because we sell only to businesses, the consumer 14-day cancellation right doesn't apply. You may cancel an order free of charge at any time before dispatch. After delivery, we accept returns of unused Goods in their original packaging only by prior written agreement. We may charge a restocking fee and you pay the return carriage. This doesn't affect your rights under the warranty.
12. Our liability
- Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, under section 12 of the Sale of Goods Act 1979, under the Consumer Protection Act 1987, or for anything else that can't be limited by law.
- Subject to that, we aren't liable for loss of profit, revenue, business, contracts, goodwill or anticipated savings, or for any indirect or consequential loss.
- Subject to that, our total liability arising from any order is limited to the price paid for the Goods in that order.
13. Events outside our control
We aren't responsible for delays or failures caused by events outside our reasonable control, such as supplier or shipping delays, strikes, extreme weather or government action. We'll tell you as soon as we can, and if the delay lasts more than 60 days either of us may cancel the affected order with a refund of anything paid for undelivered Goods.
14. Using this website
- We try to keep the information on this website accurate, but product details, specifications and prices may change. Your quote and order confirmation set out what you're buying.
- Competitor comparisons are based on public UK listings on the date shown and are for general guidance only.
- Savings estimates from the labour calculator are illustrations based on the numbers you enter, not a promise of results.
- The MuloCart name, logo, images and website content belong to us. Don't copy them for commercial use without our permission.
- Links to other websites are provided for convenience; we aren't responsible for their content.
15. Personal data
We handle personal data as described in our privacy policy.
16. General
- You may not transfer your rights under a contract without our written consent.
- If any part of these terms is found unenforceable, the rest stays in force.
- If we don't enforce a term straight away, we can still enforce it later.
- Only you and we have rights under these terms. No one else can enforce them under the Contracts (Rights of Third Parties) Act 1999.
- These terms and any contract under them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
